Нещодавно Міністерство юстиції повідомило про зміни, які очікуються на ринку мікрокредитування уже з 1 січня нового року. В останні роки збільшувалась кількість громадян, які отримували проблеми через умови маленьких споживчих кредитів, в яких не були чітко прописані умови або записані маленьким шрифтом.
Як будуть обмежуватись суми пені та штрафів? Та як зміняться мікрокредити?
Раніше мікрокредитування неадекватно регулювалось. Іноді суми штрафів за несплату боргу вчасно, могли досягати й 1000%, а потім гроші вимагали якісь колектори, іноді зовсім негуманними методами. Ще у людей були проблеми через те, що на так звані мікрокредити не поширювались вимоги щодо розкриття інформації.
Завдяки новому законодавству такі драконівські норми зникають, бо навіть якщо у договорі маленьким шрифтом прописують неймовірні розміри пені та штрафів, то вони не матимуть юридичної дії, оскільки документ підписаний клієнтом суперечитиме чинному законодавству.
Тепер кредити, сума яких не перевищує мінімалки (з/п), будуть відноситись до споживчих і регулюватись нормами закону, який регулює споживче кредитування. Це означає, що розмір усіх штрафів та пені по кредиту, що по розміру менший мінімальної заробітної плати, не може бути більшою, ніж дві суми, які отримав клієнт за цим кредитом.
Які ще важливі зміни очікуються з 1 січня:
✅ Забороняється змінювати процентну ставку за кредитом. Не можна збільшувати кількість відсотків в якості санкцій за прострочення кредиту.
✅ Кредитодавець буде обов’язково безкоштовно передавати дані стосовно всіх малих кредитів на споживчі потреби до спеціального бюро кредитних історій, які включені до відповідного Єдиного реєстру. Важливо надати інформацію хоча б одному бюро, не обов’язково усім одночасно.
✅ Перед укладанням договору, споживач має обов’язково надати доступ до своєї кредитної історії, тобто дозволити, щоб дані могли зберігати, обробляти та поширювати бюро кредитних історій. У тому випадку, якщо споживач не хоче давати згоду, то кредитодавець не має права укладати договір про кредитну операцію.
✅ Обмеження кількості укладання швидких кредитів. Це убезпечує обидві сторони. Компанії не матимуть великої дебетової заборгованості, а клієнти не отримуватись незаконні позики, щоб зберегти платоспроможність для обслуговування боргів.
Національний банк України анонсував створення нових вимог для кредитних компаній. Їх змусять вказувати повну інформацію стосовно власних кредитних продуктів на своїх веб-сайтах. Це необхідно для того, щоб кредитні бюро, які їх перевіряють, слідкували, чи відповідають умови кредитування чинному законодавству.
