The boundaries establishing of a land plot on the ground

All land plots have territory and borders, separating one territory from another. There are situations when the owners need to establish the boundaries of the land plot on the ground. Most often this should be done in the following cases:


? drilling wells;


? acquisition of land by the new owner;

? during construction on a land plot;


? in cross-border disputes with adjacent landowners / land users;


? damage or loss of previously installed boundary markers.


How are boundaries set?


The boundaries determination of a land plot consists of several stages:

1️⃣ conclusion of an agreement with a land management company for the preparation of technical documentation for the establishment (restoration) the boundaries of the land plot on the ground. To conclude an agreement with a land management organization, you must provide the following documents:


? a copy of the identity document and the registration number of the taxpayer’s registration card;


? a copy of the document confirming the ownership of immovable property located on this land plot (if any);


? a copy of the document certifying the ownership (use) of the land plot (if any);

? the decision of the local government or executive body to issue a permit for the transfer of a land plot into ownership or use with a copy indicating its location.


2️⃣ The peparatory work – analysis of source materials, data from the State Land Cadastre, legal grounds for granting land ownership (use), information on the presence of disputes along the boundaries of the land plot, etc.


3️⃣ The topographic and geodetic work – performing geodetic surveys on the ground to determine the turning points of the boundaries of land plots and the establishment of boundary markers.

⚜️ The surveyor fixes the boundaries of the land plot in kind (on the ground) with boundary marks in the presence of the owners or users of the land plot, owners (users) of the adjacent land plots or persons authorized by them.
Carrying out this procedure in the absence is possible only if they are notified of the time of the above works, specified in the act of boundary marks for storage.

⚜️ Disagreement of neighbors with the boundaries of the land plot is not a basis for the decision of local authorities to refuse to agree on the technical documentation for the land plot and to refuse to transfer such a land plot to the ownership of the applicant.


4️⃣ Local work – preparation and execution of technical documentation for land management, for the establishment (restoration) of the natural boundaries of a land plot (on the ground) and securing them with boundary marks.
