The ex-head of the MSAI has been suing for two pairs of damaged jeans for 5 years

In the Zhytomyr region, the former head of the long-disbanded traffic police is suing Eurofish LLC for damaging two pairs of jeans during dry cleaning. This funny story has been going on since 2015. On November 2 of the same year, the Zhitomir court initiated proceedings on the claim of this person against Eurofish to recover compensation for moral and material damage from them.


The situation is actually quite funny, because these are two pairs of expensive Zilli jeans. The plaintiff valued them at almost fifty thousand hryvnia. But when he handed over his clothes to dry cleaning, he indicated an approximate cost of 80 hryvnia in order to pay less for the service. But he did not take into account there is a risk of destruction of trousers after dry cleaning. It so happened they are unsuitable in the opinion of the plaintiff now. Over the years, several surveys have been ordered to determine what factors influenced the appearance of defects. It was also checked whether these trousers have defects prevent them from being used for their intended purpose.

At the time of the examination, the court sessions were stopped and resumed. This is one of the reasons why this case still exists and has not been resolved. It was assumed the examination would be carried out at the Kiev Research Institute. But this instance dragged out the process of conducting the research, until at the end of 2016 the court decided to transfer this examination to the IE of the Kirovograd region. Six months later, the court had an expert opinion. The plaintiff was dissatisfied. So he applied for a second examination. He wanted to transfer this case to the center of the Ministry of Internal Affairs in the Zhytomyr region this time.


The defendant objected, but did not agree with the choice of experts, since the plaintiff worked in the police and has connections there. So it would have been impossible to get an independent examination. However, the unreformed court decided to side with the plaintiff and instruct the examination at the center of the Ministry of Internal Affairs. The plaintiff had to pay himself for it. A year later, the forensic medical center of the Ministry of Internal Affairs announced it could not conduct such an examination. The court ordered an expert examination by an independent institution in Kiev. However, there was no expert examination either.


As a result, even the plaintiff, who stopped coming to the scheduled court sessions, got tired of it. The court decided to leave the claim without consideration in November 2019. The plaintiff did not like this decision. He filed an application with the Zhytomyr Court of Appeal. It decided to continue the consideration of the case in the first court. The court is still considering the case for damages in the amount of UAH 47,000,750. The next meeting will take place on April 19, 2021.

This amount looks very ridiculous when we consider two factors.


? The authorized capital of this dry cleaner is UAH 100 000. It is twice the amount of the claim.

? Volodymyr Nedilskyi, who held a position in the MSAI from 2006 to 2010, ran for the Verkhovna Rada of Ukraine in 2019. He declared three real estate objects worth 5 million hryvnias, three cars, his own company and one and a half million hryvnias in cash.
