The child support when the couple divorced

There are many stories: “Some time after the birth of the child, the couple stopped living together. A woman who is forced to stay at home while raising a small child has virtually no income other than “children’s” funds. According to Article 84 of the Family Code of Ukraine, every woman with whom a child lives has the right to alimony from her husband until their joint child reaches the age of three.


A similar problem arose in the Krasilov Bureau of Legal Aid of the Starokonstantinovsky Local Center for Free Secondary Legal Aid. They were approached by a woman who was in a registered marriage, but did not live with her husband. The couple have a son who is less than two years old at the time of application. According to the woman, she is busy taking care of the child and needs financial assistance, but her husband, although he works, does not help her financially.


A lawyer from the Legal Aid Bureau explained to the woman: a wife with a child, regardless of whether she works or not, depending on her financial situation, is entitled to financial support from her ex-husband.

She helped the client to prepare a corresponding statement of claim to the court. The court ruled to satisfy it and to recover from the husband funds for the maintenance of his wife in the amount of 1/4 of all types of his earnings per month until the child reaches the age of three. Every child has the right to help from both parents, and this right is protected by the law of Ukraine.
