The rules for hiring foreigners and stateless persons

The Constitution of Ukraine provides foreigners and stateless persons legally residing in Ukraine enjoy the same rights and freedoms and bear the same obligations as citizens of Ukraine, with the exception of the Constitution, laws or international treaties. Foreigners can work in enterprises, institutions and organizations or engage in other work on the grounds and in the manner established for citizens of Ukraine.


The work of foreigners and stateless persons may be permitted for different positions by one or more (two or more) employers, provided that work is permitted for each position. The work of foreign highly paid specialists can be used without a compatibility permit if the term of the employment contract does not exceed the validity period of the pass at the main place of work.


A foreign employee may qualify for a position determined by the absence of a temporarily absent employee, provided that the combination lasts no more than 60 calendar days in a calendar year. Foreigners and stateless persons cannot be appointed or employed if, in accordance with the law, the appointment to the relevant position or the conduct of the relevant activity is associated with the possession of Ukrainian citizenship. Only in cases provided by international treaties of Ukraine, consent to the obligation by the Supreme Council of Ukraine.
